ELEMENT79 — Terms of Service

1. Acceptance of Terms

By accessing or using the Platform, you agree to these Terms of Service. If you represent a business, you confirm that you have the authority to bind that entity.

2. Role of Element79

Marketplace only: We connect Clients and Freelancers but are not a party to their contracts.
Payments via PSPs: Transactions are processed by independent payment service providers.
No gambling or high-risk financial services: Such use is strictly prohibited.

3. Eligibility and Accounts

Minimum age: 18 years or legal majority.
Account security: You are responsible for your credentials.
KYC/KYB: We may request identity and compliance data per law.

4. User Content; Projects and Deliverables

Users are responsible for their content and must own or have rights to use it. Moderation and content removal may occur to ensure legal and policy compliance.

5. Prohibited Activities (Strict)

The following are strictly prohibited, including attempts to facilitate or advertise them:

• Gambling & similar: betting, lotteries, raffles, casino-type games.
• High-risk or unlawful payments: unlicensed money services, securities trading, crypto mixing.
• Illegal content: fraud, hacking, IP infringement, malware.
• Adult exploitation: CSAM, escorting, narcotics, weapons.
• Platform abuse: spam, fake reviews, chargeback fraud, bypassing fees.

6. Fees, Taxes, Refunds, and Chargebacks

Users are responsible for taxes. Refunds and chargebacks are handled via PSP rules. Cooperation is required for dispute resolution.

7. Sanctions and Compliance

Users must comply with AML/CFT and sanctions laws. We may screen and restrict access accordingly.

8. Third-Party Services

We are not responsible for external services linked through the Platform.

9. Warranties & Disclaimers

The Platform is provided “as is”. We do not guarantee continuous or error-free operation.

10. Limitation of Liability

We are not liable for indirect or consequential damages. Aggregate liability is limited to EUR 1000 or the fees paid in the last three months.

11. Suspension and Termination

We may suspend or terminate access for violations of these Terms or legal obligations.

12. Notice and Reporting

Report violations via info@omnibuild.live.

13. Governing Law and Disputes

Governed by the laws of Poland. Exclusive jurisdiction: Warsaw, PL.

14. Changes to the Terms

We may update these Terms periodically. Continued use constitutes acceptance.
